Intellectual Property Disputes
divider
For many companies, intellectual property (IP) isn’t just a valuable element of their business, it provides their competitive edge. At Osborne Clarke, we work with our clients to implement IP protection and enforcement strategies that maximise the value of their IP assets.

IP disputes are sometimes inevitable. After all, market share is often at stake. In recognition of this, we have teams of IP lawyers dedicated specifically to litigation and dispute resolution, with strength in depth across all areas of IP, whether it be complex patent litigation or devising and pursuing a long-term anti-counterfeiting strategy across the UK, Europe and world-wide.

You’ll have at your disposal a top team of European lawyers, with access to further international lawyers, thus providing a coordinated approach to help you protect your IP around the World.

We deal with the full range of IP disputes, including patent infringement and validity; anti-counterfeiting; confidential information and trade secrets; copyright, design rights and database rights; trade marks, passing off/unfair competition and parallel imports; cybersquatting/domain name disputes; as well as disputes concerning proprietorship and licensing of intellectual property rights.

Whatever the dispute, our advice is always commercially focused; we believe in delivering results quickly and cost-effectively. This commercial focus is backed up by our specialist skills. Our active membership of the Chartered Institute of Patent Agents, the Institute of Trade Mark Attorneys, LES and the Anti-Counterfeiting Group also helps us keep up-to-date with current issues and best practice. Some companies fear that, most of all during a dispute, the control passes from them to their lawyers. That is not our philosophy. We work in partnership with our clients and, whilst being proactive, will always ensure that they 'stay in the loop' and are able to take informed decisions at every stage.

Examples of our recent experience include:
  • Advised Stanelco on multi-jurisdictional patent infringement actions relating to biopolymer technology
  • Advised Dominos on trade mark litigation brought by Hot Stuff Foods Inc in relation to Dominos Hot Stuff Pizza promotion
  • Implementing trade mark and design right enforcement campaigns for Mulberry to combat counterfeit and copy bags in the UK, Spain and Sweden
